Guardianship Services in North Dakota

Guardianship is a legal process designed to protect individuals who are unable to make or communicate important decisions for themselves. This may include older adults with declining decision-making ability, individuals with intellectual disabilities, or people experiencing mental health challenges, traumatic brain injuries, or physical conditions that affect their capacity to make safe choices. When a court determines that a person is legally incapacitated, a guardian will be appointed to help ensure their well-being and protect their rights.

Guardians play an important role in supporting the individual’s best interests while promoting as much independence as possible. Depending on the person’s needs, a guardian may help make decisions related to housing, healthcare, finances, legal, or other essential matters. Guardianship is established through a court order and remains under court supervision, ensuring that decisions are made responsibly and tailored to the individual’s strengths, needs, and quality of life.

What is guardianship and when is it needed?

Guardianship is a legal arrangement in which a court appoints an individual or organization to make certain decisions on behalf of someone who is unable to do so independently. Guardianship may be needed when a person cannot safely manage their healthcare, finances, legal, or life decisions due to disability, illness, or other circumstances.

Catholic Charities North Dakota provides two separate guardianship programs designed to support at-risk adults. One program focuses on individuals with intellectual disabilities, while the other serves vulnerable adults experiencing challenges related to aging, illness, or other life circumstances. Both programs take an individualized approach, carefully evaluating each case to ensure services align with the person’s unique needs and best interests.

Our professional guardians advocate for the individual while working closely with service providers, community partners, and support systems. Support may include healthcare decision-making, financial oversight, care coordination, and ensuring the individual’s rights, safety, and dignity are protected.

To begin, contact Catholic Charities North Dakota to discuss your situation. Our team can help explain the guardianship process, and guide you through next steps, including referrals and court involvement when needed.
